REFUND POLICY
Last updated: 15 August 2026
ETHOSALIS presents individually selected artworks, many of which are unique, handmade, vintage, pre-owned, or accompanied by artist documentation and a signed storage box. Please review all images, dimensions, condition information, material characteristics, and supporting documentation carefully before confirming an acquisition.
GENERAL RETURN POSITION
Except where applicable law provides a mandatory right of withdrawal or another non-excludable consumer remedy, or where ETHOSALIS expressly agrees otherwise in writing, all confirmed acquisitions are final and we do not accept returns solely because a collector has changed their mind, reconsidered the suitability of an artwork for a particular space or use, or formed a different subjective impression after delivery.
Nothing in this policy excludes or restricts any consumer right that cannot legally be excluded.
HANDMADE AND KILN-FIRED CHARACTERISTICS
Many artworks presented by ETHOSALIS are individually handmade and kiln-fired. Natural characteristics may include glaze crazing, kiln marks, ash deposits, shell marks, feldspar eruptions, stone bursts, firing distortion, colour variation, uneven surfaces, and traces of hand-forming.
Where these characteristics are visible in the photographs, identified in the artwork description or condition information, or are reasonably inherent to the stated ceramic tradition and firing process, they form part of the artwork’s material character and are not considered damage, manufacturing defects, or non-conformity.
This provision does not apply to undisclosed structural cracks, chips, restoration, material instability, or damage occurring during shipment. Product images, dimensions, condition notes, and disclosed material characteristics form part of the artwork description.
VINTAGE AND PRE-OWNED WORKS
Vintage and pre-owned artworks are offered in the condition described and photographed at the time of sale. Depending on their age, history, material, and prior ownership, they may display patina, surface wear, minor scratches, discolouration, storage marks, old labels, signs of historical use, box wear, documentation wear, or previously disclosed repair or restoration.
Where such characteristics have been disclosed, are visible in the photographs, or are reasonably consistent with the stated age and nature of the artwork, they form part of its condition and are not considered damage or material misdescription.
This does not exclude responsibility for undisclosed material damage, structural instability, or a material discrepancy between the artwork supplied and its published description.
PHOTOGRAPHY AND DIMENSIONS
ETHOSALIS makes reasonable efforts to present each artwork accurately. Colour and surface appearance may vary slightly because of lighting, photography, screen calibration, browser settings, or the reflective and variable nature of ceramic glazes and other materials.
Dimensions and capacities may be approximate and are generally measured by hand. Minor, non-material differences in colour, appearance, dimensions, or capacity do not by themselves constitute damage or material misdescription, provided that the artwork remains substantially consistent with its description and photographs.
Collectors who require additional photographs, measurements, or condition information should contact us before confirming an acquisition.
ACQUISITION CONFIRMATION
An artwork inquiry, viewing request, reservation request, hold request, website submission, or automated acknowledgement does not by itself constitute a completed purchase or binding acquisition agreement.
An acquisition becomes confirmed only when ETHOSALIS sends written confirmation accepting the acquisition and payment has been received or otherwise expressly agreed in writing.
CANCELLATIONS BEFORE DISPATCH
If you wish to request cancellation before an artwork has been dispatched, contact inquiry@ethosalis.art immediately.
ETHOSALIS will make reasonable efforts to accommodate the request, but cancellation cannot be guaranteed once packing, insurance, export documentation, customs preparation, collection, or shipment arrangements have begun.
Where ETHOSALIS accepts a discretionary cancellation, any identifiable and non-recoverable third-party cost already incurred may be deducted from the refund where legally permitted. We will disclose any such proposed deduction before processing the cancellation.
This section does not limit any mandatory cancellation or withdrawal right provided by applicable law.
RETURNS AND STATUTORY WITHDRAWAL RIGHTS
Contact inquiry@ethosalis.art before returning any artwork. We will provide the appropriate return address, packing requirements, and shipping instructions.
The business correspondence address published on this website is not necessarily the correct return address. Unauthorised returns, returns sent to an incorrect address, or returns made without following reasonable instructions may be refused to the extent permitted by applicable law.
Where applicable law provides an eligible consumer with a mandatory right of withdrawal from a distance sale, that right will apply for the period and subject to the conditions required by that law. In jurisdictions providing a 14-day withdrawal period, notice must ordinarily be given within 14 days after the artwork enters the physical possession of the eligible consumer or their designated recipient.
Unless applicable law requires otherwise, the customer must return the artwork promptly after giving notice and within the applicable statutory return period.
CONDITION OF RETURNED ARTWORKS
An artwork must be returned in the same condition in which it was received, together with all original packaging, artist boxes, storage boxes, cloths, certificates, artist documentation, provenance documents, labels, mounts, accessories, and other accompanying materials.
No artwork may be cleaned, polished, repaired, restored, modified, treated, mounted, reframed, or otherwise altered before return.
Any missing, damaged, substituted, or materially altered box, certificate, documentation, cloth, label, mount, or accessory may reduce the collectible and commercial value of the artwork.
ACTUAL USE OF CERAMIC AND FUNCTIONAL FORMS
Visual inspection is generally sufficient to establish the nature, appearance, dimensions, and condition of a ceramic artwork or functional form.
Contact with tea, water, alcohol, food, incense, oil, fragrance, cleaning products, or any other substance, together with washing, soaking, polishing, seasoning, heating, or other practical use, constitutes actual use rather than reasonable inspection.
Except where applicable law requires otherwise, an artwork that has been actually used is not eligible for a discretionary change-of-mind return.
Where a mandatory statutory return right applies, ETHOSALIS may, to the fullest extent permitted by law, reduce the refund to reflect any loss in value caused by handling or use beyond what was reasonably necessary to establish the nature, characteristics, and condition of the artwork. Where actual use has made the artwork unsuitable for resale in its original stated condition, the resulting reduction may be substantial and may extend to the full loss in value where legally permitted.
RETURN PACKING, SHIPPING, AND INSURANCE
For a return unrelated to damage, incorrect delivery, or material misdescription, the customer is responsible, where permitted by applicable law, for:
-
obtaining prior return instructions;
-
securely packing the artwork in accordance with those instructions;
-
using the original packing materials where reasonably suitable;
-
arranging insured and trackable return shipping;
-
insuring the shipment for the full acquisition value;
-
preparing accurate customs and return documentation; and
-
paying the direct cost of return shipping.
The customer must not describe a return inaccurately for customs purposes or attempt to avoid legally applicable customs procedures.
For return shipping arranged independently by the customer, the artwork remains at the customer’s risk until it is physically received at the authorised return destination, to the extent permitted by applicable law.
ETHOSALIS is not responsible for loss, damage, customs charges, storage charges, or other costs arising from an unauthorised return, incorrect address, inadequate packing, insufficient insurance, inaccurate customs documentation, or failure to follow reasonable return instructions.
DAMAGED, INCORRECT, OR MATERIALLY MISDESCRIBED WORKS
Inspect the artwork and packaging as soon as reasonably possible after delivery.
If an artwork arrives damaged, is not the artwork ordered, or is materially different from its published description, contact inquiry@ethosalis.art as soon as possible, preferably within 48 hours of delivery.
Please provide clear photographs of:
-
the artwork;
-
the affected area;
-
the inner and outer packaging;
-
the shipping label; and
-
any visible impact or damage to the package.
Do not discard the packaging or attempt to clean, use, repair, restore, or otherwise alter the artwork before receiving instructions from ETHOSALIS.
The original packaging may be required for a carrier or insurance claim. A delay in notification or failure to retain evidence may impair our ability to pursue that claim, although it will not by itself exclude a consumer right that cannot legally be waived.
Where a claim is accepted, the appropriate remedy will be determined having regard to applicable law, the nature and condition of the artwork, its uniqueness, and the availability of an equivalent work. The remedy may include return, repair or restoration assessment, replacement where available, a proportionate price reduction, full or partial refund, or another solution agreed with the collector.
Where applicable law requires ETHOSALIS to bear the reasonable return cost for a damaged, incorrect, or materially misdescribed artwork, we will provide return instructions or arrange collection.
NON-RETURNABLE ITEMS
To the extent permitted by applicable law, the following are not eligible for discretionary cancellation or change-of-mind return:
-
commissioned or personalised works;
-
works made or modified to the collector’s specifications;
-
works specially sourced for an individual collector;
-
works altered, mounted, framed, repaired, or restored at the collector’s request;
-
works clearly identified before purchase as final sale or non-returnable;
-
vintage, pre-owned, consigned, fragile, or special-condition works expressly identified as final sale;
-
works that have been used, washed, soaked, cleaned, polished, treated, altered, treated, altered, damaged, or improperly stored after delivery; and
-
works returned without material accompanying documentation, boxes, certificates, or accessories supplied with the acquisition.
A final-sale or non-returnable designation does not exclude a remedy for proven transit damage, incorrect delivery, material misdescription, or any consumer right that cannot legally be excluded.
REFUND AMOUNTS
For a discretionary change-of-mind return accepted by ETHOSALIS, original shipping, packing, insurance, customs duties, import taxes, brokerage charges, and other third-party costs are not refundable except where ETHOSALIS agrees otherwise in writing or applicable law requires otherwise.
Any identifiable, non-recoverable third-party charge will only be deducted where legally permitted and, where required, disclosed to the customer.
Where a mandatory statutory withdrawal right applies, ETHOSALIS will refund the amounts required by applicable law. This may include the cost of the least expensive standard delivery method offered for the acquisition, but does not include additional costs arising from an expedited, premium, customised, or collector-selected delivery method unless required by law.
Customs duties, import taxes, brokerage charges, and similar amounts paid directly to customs authorities, carriers, or other third parties are generally outside the control of ETHOSALIS. Applications for their repayment may need to be made directly to the relevant authority or service provider. ETHOSALIS will provide reasonable supporting documentation where available.
REFUND TIMING AND METHOD
Approved refunds will be issued to the original payment method.
For returns accepted under this policy, refunds will normally be processed within 10 business days after the artwork has been received at the authorised return destination and its condition, packaging, and accompanying materials have been inspected.
Where applicable law requires an earlier or different refund deadline, that mandatory deadline will apply. Where legally permitted, ETHOSALIS may withhold a statutory refund until the artwork has been received or the customer provides satisfactory evidence that it has been returned.
Refunds will be made in the currency of the original transaction. ETHOSALIS is not responsible for differences caused by exchange-rate movements or charges imposed by the customer’s bank, card issuer, payment provider, or currency-conversion service.
RETURN DAMAGE AND VALUE REDUCTION
Where an artwork is returned damaged, used, incomplete, altered, inadequately packed, or without material accompanying items, ETHOSALIS may reject a discretionary return or reduce the refund to reflect the resulting loss in value, restoration cost, missing documentation, missing accessories, or other direct loss, to the fullest extent permitted by applicable law.
Nothing in this policy excludes, restricts, or replaces any consumer right or remedy that cannot legally be excluded in the customer’s jurisdiction.
