SHIPPING AND DELIVERY POLICY

This Shipping and Delivery Policy applies to artworks and related items supplied by ETHOSALIS through ethosalis.art, through a private quotation, or under an ETHOSALIS order confirmation.

ETHOSALIS is operated by the Hong Kong company identified in our Terms of Service, Legal Notice and Contact Information. Fulfilment facilities, export agents, customs brokers and carriers act solely as service providers and are not the contracting seller unless expressly stated otherwise.

  1. DISPATCH AND FULFILMENT

Orders are fulfilled through ETHOSALIS’s designated logistics facilities.

Depending on the customs status and location of an artwork, fulfilment may be handled through a standard fulfilment facility or a customs-supervised bonded logistics facility in Mainland China.

The particular facility, export port, customs broker or logistics provider used for an order may vary according to the artwork, destination, security requirements and available transport route.

The use of a particular fulfilment facility does not alter the stated authorship, country of origin, provenance, authenticity or condition of an artwork.

  1. PROCESSING TIME

Processing begins after:

  • payment has cleared;

  • the order has been accepted;

  • the delivery address and recipient telephone number have been confirmed;

  • any identity, customs or import information reasonably required for delivery has been supplied; and

  • any requested documentation, condition report or special packing arrangement has been confirmed.

Orders are ordinarily prepared for dispatch within 3–7 business days.

High-value artworks, specialist packing, custom crating, export documentation, condition reporting or customs-supervised handling may require up to 10 business days or another period expressly agreed with the collector.

Processing times do not include weekends, public holidays, international transit time or customs-clearance time.

If a material delay occurs before dispatch, ETHOSALIS will contact the collector using the email address supplied with the order.

Where applicable mandatory law requires delivery within a particular period, those statutory rights remain unaffected. If delivery is expected to require more than 30 days from conclusion of the contract, the longer delivery period will be disclosed and expressly agreed before the order is finalised.

  1. SHIPPING CHARGES

Shipping charges are calculated according to factors including:

  • destination;

  • dimensions and weight;

  • declared value;

  • packing or crating requirements;

  • insurance availability;

  • carrier and service level;

  • remote-area surcharges; and

  • specialist handling or customs requirements.

The applicable shipping charge will be shown at checkout or stated in the quotation, invoice or order confirmation before payment.

Shipping is included in the artwork price only where this is expressly stated. Any optional service requested by the collector, including priority delivery, specialist art handling or custom packaging, may incur an additional charge.

  1. SHIPPING METHODS

Depending on the artwork, destination and declared value, ETHOSALIS may use DHL, FedEx, UPS, EMS, a premium regional courier, a specialist art-logistics provider or another appropriately qualified carrier.

ETHOSALIS may select or change the carrier or service level where reasonably necessary to protect the artwork, comply with carrier restrictions or improve the reliability of delivery, provided that this does not materially reduce an expressly agreed service without informing the collector.

We do not ordinarily deliver to PO boxes, parcel lockers, hotels or temporary accommodation unless expressly approved in writing before dispatch.

  1. ESTIMATED TRANSIT TIME

Estimated transit times after dispatch are ordinarily:

  • international express delivery: 5–12 business days; and

  • economy, consolidated or specialist art logistics: 10–30 business days.

These periods are estimates and are not guaranteed delivery dates. The estimate stated in the applicable quotation or order confirmation will take priority.

Delivery may take longer because of customs inspections, security checks, weather, public holidays, carrier disruption, remote-area service limitations, regulatory action or events outside ETHOSALIS’s reasonable control.

Collectors should inform us before payment if delivery by a particular date is essential. A requested delivery date becomes binding only if ETHOSALIS expressly accepts it in writing.

  1. TRACKING INFORMATION

Where tracking is available, the tracking number will be sent to the email address supplied with the order after the shipment has been accepted and scanned by the carrier.

Tracking information may take 24–72 hours to begin displaying movement. Certain specialist art-logistics services may provide milestone updates rather than continuous online tracking.

The collector is responsible for monitoring tracking information and responding promptly to communications from the carrier, customs authority or customs broker.

If tracking shows no movement for an unusual period, please contact inquiry@ethosalis.art. ETHOSALIS will request an investigation from the carrier where appropriate.

  1. SIGNATURE, INSURANCE AND DELIVERY

A signature may be required for all deliveries. High-value artworks will ordinarily require an adult signature or another identity-verified delivery method.

Where available and commercially reasonable, shipments will be insured against loss or physical damage in transit up to the applicable declared or invoiced value.

Delivery is completed when the parcel is placed in the physical possession of the collector or a person authorised to receive it at the confirmed delivery address.

Collectors should not request that a carrier leave an artwork unattended. ETHOSALIS may decline an unattended-delivery request for security or insurance reasons.

Where ETHOSALIS selects and contracts the carrier, ETHOSALIS remains responsible for transit risk until the collector or an authorised recipient takes physical possession, to the extent required by applicable law.

Different rules may apply where the collector independently selects and contracts a carrier that was not offered or arranged by ETHOSALIS.

  1. COUNTRY OF ORIGIN AND SHIPPING DOCUMENTS

The country of dispatch may differ from the country of origin of an artwork.

Dispatch location does not determine an artwork’s authorship, cultural origin or provenance. These matters will be stated separately in the applicable artwork description and documentation.

Commercial invoices, packing lists, customs declarations and carrier documents may identify an authorised fulfilment provider, exporter, customs broker or logistics company in addition to ETHOSALIS.

The appearance of such a service provider on shipping or customs documentation does not make that provider the contracting seller.

ETHOSALIS and its service providers will complete customs documentation accurately and will not declare an artwork as a gift or artificially reduce its value.

  1. CUSTOMS, DUTIES, TAXES AND CLEARANCE

The quotation, checkout information, invoice or order confirmation will state whether applicable import duties and taxes are:

  • included or prepaid;

  • collected at checkout; or

  • payable by the recipient upon import.

Unless expressly stated as included, artwork prices and shipping charges do not include import duty, import VAT or GST, customs-brokerage fees, carrier disbursement fees, storage charges or other destination-country import costs.

These amounts may be charged separately by a customs authority, carrier or customs broker. ETHOSALIS does not control these charges and cannot guarantee their amount.

The collector may be required to provide identification, a tax number, importer information, a power of attorney or other information required by the destination country. The collector must respond promptly and accurately to reasonable clearance requests.

Customs processing and inspection are outside ETHOSALIS’s direct control. A customs delay does not by itself mean that the shipment is lost or that ETHOSALIS has failed to dispatch it.

Nothing in this section limits any obligation imposed on ETHOSALIS by applicable tax, customs or consumer law.

  1. DELIVERY ADDRESS

The collector is responsible for checking that the recipient name, delivery address, postcode, email address and telephone number are complete and accurate before payment or final order confirmation.

An address-change request must be sent to inquiry@ethosalis.art within 24 hours after order confirmation and before carrier booking, export-document finalisation or dispatch, whichever occurs earlier.

ETHOSALIS will make reasonable efforts to accommodate a timely request but cannot guarantee that an address can be changed.

Once an artwork has been handed to the carrier, its address usually cannot be changed. If interception or redirection remains possible, the collector may be responsible for reasonable carrier, storage, redirection or re-documentation costs to the extent permitted by law.

For security reasons, ETHOSALIS may require identity or payment verification before approving a change to the delivery address.

  1. ORDER CANCELLATION BEFORE DISPATCH

A cancellation request should be sent to inquiry@ethosalis.art within 24 hours after order confirmation and before carrier booking, export-document finalisation or dispatch, whichever occurs earlier.

A cancellation request is not effective until acknowledged by ETHOSALIS in writing.

Once an artwork has been dispatched, the order ordinarily cannot be cancelled as an unshipped order. Any subsequent return or withdrawal request will be handled under the Return and Refund Policy and applicable mandatory law.

Reasonable non-recoverable costs already incurred for custom packing, specialist documentation, carrier booking or requested services may be deducted only where permitted by applicable law and disclosed to the collector.

Nothing in this section restricts any mandatory statutory cancellation or withdrawal right.

  1. REFUSED, UNCLAIMED OR UNDELIVERABLE SHIPMENTS

The collector must cooperate with delivery and customs-clearance arrangements.

If delivery cannot be completed because of an incorrect address, repeated absence, failure to provide clearance information, refusal to pay properly disclosed import charges or refusal to accept delivery without a legally valid reason, the shipment may be returned, stored or otherwise handled in accordance with the carrier’s rules and applicable law.

Where permitted by law, reasonable return transport, storage, customs, re-importation, redelivery and administrative costs caused by such failure may be charged to the collector or deducted from any refund.

Original shipping charges are not refundable in these circumstances except where mandatory law requires otherwise.

Please do not refuse a visibly damaged shipment without documenting the damage and contacting ETHOSALIS or following the carrier’s damage procedure where reasonably possible.

  1. INSPECTION ON DELIVERY

The collector or authorised recipient should inspect the outer packaging at the time of delivery.

Where visible damage is present:

  • photograph the package before opening;

  • ask the carrier to record the damage on the delivery receipt or electronic record;

  • retain a copy of any notation or carrier report; and

  • open the package carefully while documenting the unpacking process.

If permitted by the carrier and reasonably appropriate, the collector may ask the driver to remain while visible external damage is documented.

  1. TRANSPORT DAMAGE

Transport damage should be reported to inquiry@ethosalis.art within 48 hours after delivery, or as soon as reasonably possible after discovery.

The 48-hour reporting request helps ETHOSALIS preserve carrier and insurance claims. It does not remove or reduce any mandatory consumer right or legal guarantee.

The damage report should include:

  • the order number;

  • photographs of every side of the outer package;

  • photographs of the shipping label;

  • photographs of the internal packing materials;

  • clear photographs of the artwork and damaged area;

  • photographs of any tomobako, presentation box, documentation or accessories; and

  • an unpacking video, if available.

The collector must retain the artwork, outer carton, internal packing, labels, documentation and accessories until ETHOSALIS or the carrier confirms that they may be discarded.

A reportedly damaged artwork must not be used, washed, soaked, cleaned, polished, repaired or altered before assessment.

Please do not return a damaged artwork without written return instructions. An unauthorised return may interfere with the carrier investigation, insurance claim, customs treatment or safe handling of the artwork.

ETHOSALIS will review the evidence and, where appropriate, open a claim with the carrier or insurer.

Because many artworks are unique, an identical replacement may not be available. Depending on the circumstances, applicable law and the collector’s agreement, the remedy may include professional conservation, repair, a proportionate price reduction, cancellation and refund, or another appropriate resolution.

  1. DELAYED OR LOST SHIPMENTS

A shipment is not considered lost solely because tracking is delayed or customs clearance is taking longer than expected.

If a shipment is materially delayed, ETHOSALIS will request a carrier investigation where appropriate. International carrier investigations may require time to complete.

If the carrier or insurer confirms that an artwork has been lost, ETHOSALIS will provide the remedy required by applicable law and the circumstances of the order.

As artworks may be unique, replacement with an identical work may not be possible.

  1. RETURN SHIPPING

All returns require prior written authorisation and return instructions from ETHOSALIS.

The authorised return destination may differ from the original dispatch facility and will be determined according to the artwork’s customs status, condition and applicable import or re-import requirements.

No artwork may be returned to Hong Kong, Mainland China, a bonded facility, a fulfilment provider, an export agent or any published business address without prior written return instructions from ETHOSALIS.

An unauthorised return may be refused where permitted by law and may result in additional customs, storage, transportation or administrative costs.

Return eligibility, return costs, permitted inspection, condition requirements, diminished value and refunds are governed by the ETHOSALIS Return and Refund Policy and applicable mandatory law.

  1. EVENTS OUTSIDE OUR REASONABLE CONTROL

ETHOSALIS is not responsible for delay caused solely by events outside its reasonable control, including severe weather, natural disaster, epidemic, war, civil disruption, carrier strike, customs action, transport shutdown, government restriction or security incident.

Where such an event materially affects delivery, ETHOSALIS will communicate with the collector and take reasonable steps to reduce the disruption.

Nothing in this section limits rights that cannot lawfully be excluded.
